AN ORDINANCE AUTHORIZING THE MUNICIPAL MANAGER TO ENTER INTO A LEASE AGREEMENT WITH R.A.A. SERVICES FOR SPACE ON A WATER STAND-PIPE STRUCTURE LOCATED AT 655 WEST TEXAS AVENUE; AND DECLARING AN EMERGENCY.
WHEREAS the Village has been approached by representatives of R.A.A. Services requesting an agreement to place an antenna on the Village Stand-Pipe located at 655 West Texas Avenue; and
WHEREAS said antenna will allow Village residents and businesses to receive high speed internet access; and
WHEREAS R.A.A. Systems will provide internet access to the Water Treatment Plant and a telemetry connection between the Stand Pipe on Texas Avenue and the Water Treatment Plant free of charge for the duration of the contract.
NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO:
Section 1: That the Municipal Manager is hereby authorized to enter into a lease agreement with R.A.A. Services for space on a water Stand-Pipe located at 655 West Texas Avenue within the Village of Sebring in substantially the same as the lease agreement attached hereto, and incorporated herein.
Section 2: That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.
Section 3: That this Ordinance is hereby determined to be an EMERGENCY MEASURE necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Municipality of Sebring, Ohio and for the further reason that the same is necessary to ensure the timely installation of the antennae and associated equipment.
