AN ORDINANCE AUTHORIZING AND DIRECTING THE MUNICIPAL MANAGER TO ENTER INTO A CONTRACT NOT TO EXCEED THREE HUNDRED ELEVEN THOUSAND SEVEN HUNDRED SIXTY DOLLARS ($311,760.00) WITH MICHAEL BENZA & ASSOCIATES, INC. FOR DESIGN AND CONSTRUCTION ADMINISTRATION OF THE CARBON FILTRATION SYSTEM AT THE WATER TREATMENT PLANT; AND DECLARING AN EMERGENCY.
WHEREAS the Village of Sebring has determined the need to reduce levels of Trihalomethane and Haloacetic acid at the Water Treatment Plant to maintain compliance with current EPA guidelines; and
WHEREAS a pilot study has been completed and determined a carbon filtration system would be the most effective method of reducing Trihalomethane and Haloacetic acid levels at the Water Treatment Plant.
WHEREAS the Village of Sebring has applied for and received a zero interest loan from the Ohio Public Works Commission to cover the anticipated cost of $1,819,664 for the engineering and construction of the carbon filtration system.
WHEREAS the Village of Sebring has received permission from the Ohio Public Works Commission to enter into an agreement for engineering services for the carbon filtration system prior to the official award of the zero interest loan in July, 2011.
NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO:
Section 1: That the Interim Municipal Manager is hereby authorized and directed to enter into a contract with Michael Benza & Associates, Inc. for a sum not to exceed Three
Hundred Eleven Thousand Seven Hundred Sixty Dollars ($311,760.00) for the design and construction administration of the carbon filtration system and the Water Treatment Plant.
Section 2: That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.
Section 3: That this Ordinance is hereby determined to be an EMERGENCY MEASURE necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Municipality of Sebring, Ohio and for the further reason that the same is necessary to begin the design of the carbon filtration system in a timely manner.
