AN ORDINANCE AUTHORIZING AND DIRECTING THE MUNICIPAL MANAGER TO ENTER INTO A CONTRACT WITH NORTH STAR ASPHALT INCORPORATED OF NORTH CANTON, OHIO FOR THE 2011 STREET PAVING PROJECT; AND DECLARING AN EMERGENCY.
WHEREAS the Village Council has created the 2011 Street Paving Program to identify and repave certain municipal roadways in need of improvement; and
WHEREAS Sealed bids for the construction of the 2011 Street Paving Project, being duly solicited and received by the Village of Sebring, were opened at 12:00 p.m. on April 20, 2011 within Village Council Chambers.
WHEREAS North Star Asphalt, Incorporated of North Canton, Ohio has submitted the lowest best bid of $63.75 per ton laid (Intermediate course), $63.75 per ton laid (Top Course), $2.40 per gallon (Tac Coat), $15.00 per square foot (Milling) at an estimated cost of One Hundred Twenty Six Thousand Four Hundred Sixty One Dollars and Twenty Four Cents ($126,461.24).
NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO:
Section 1: That the Municipal Manager is hereby authorized and directed to enter into a contract with North Star Asphalt Incorporated of North Canton, Ohio at a rate of $63.75 per ton laid (Intermediate course), $63.75 per ton laid (Top Course), $2.40 per gallon (Tac Coat), $15.00 per square foot (Milling) at an estimated cost of One Hundred Twenty Six Thousand Four Hundred Sixty One Dollars and Twenty Four Cents ($126,461.24).
Section 2: That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.
Section 3: That this Ordinance is hereby determined to be an EMERGENCY MEASURE necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Municipality of Sebring, Ohio and for the further reason that the same is necessary to ensure the timely construction of Municipal improvements.
