AN ORDINANCE AUTHORIZING AND DIRECTING THE MUNICIPAL MANAGER TO ENTER INTO A CONTRACT WITH CTI ENGINEERS, INC. TO PROVIDE ENGINEERING PLANNING SERVICES FOR PHOSPHORUS REDUCTION AND SLUDGE TANK IMPROVEMENTS AT THE WASTEWATER TREATMENT PLANT FOR A SUM NOT TO EXCEED SIXTY THOUSAND DOLLARS ($60,000.00); AND DECLARING AN EMERGENCY.
WHEREAS under the Village’s NPDES permit issued through the Ohio Environmental Protection Agency the Village is required to reduce the levels of phosphorus in the Wastewater Treatment Plant’s discharge by September 1, 2013; and
WHEREAS has requested from the Ohio Environmental Protection Agency a six month extension on the timeline to reduce phosphorus levels in the Wastewater Treatment Plant’s discharge until March 1, 2014; and
WHEREAS the Village Council desires to determine whether savings can be realized in annual sludge hauling costs at the Wastewater Treatment Plant by installing a blower system and a decant pipe on the sludge tank.
WHEREAS CTI Environmental, Inc. has submitted a proposal to the Village of Sebring to plan for the improvements to the sludge tank and the reduction of phosphorus
levels in the Wastewater Treatment Plant’s discharge as required by the Ohio Environmental Protection Agency within the Village’s NPDES permit.
NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO:
Section 1: That the Municipal Manager is hereby authorized and directed to enter into a contract with CTI Engineers, Inc. to provide engineering planning services for phosphorus reduction and sludge tank improvements at the Wastewater Treatment Plant for a sum not to exceed Sixty Thousand Dollars ($60.000.00)
Section 2: That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.
Section 3: That this Ordinance is hereby determined to be an EMERGENCY MEASURE necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Municipality of Sebring, Ohio and for the further reason that engineering services are necessary to ensure the Village meets the requested timeline extension within the NPDES permit for the reduction of phosphorus discharge levels at the Wastewater Treatment Plant.
