AN ORDINANCE AMENDING THE SEBRING

WATER AND SEWER RULES AND REGULATIONS: AND DECLARING AN EMERGENCY

 

            WHEREAS, Sebring Village Council has reviewed the Water and Sewer Rules and Regulations and determined that an Amendment is necessary to address delinquent water account users who attempt to sign for new service at different addresses; and

 

            WHEREAS, Sebring Village Council has determined that a water account user that has failed to maintain full and complete responsibility of their water account should not be entitled to open any new account in their name; and

 

            THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE VILLAGE OF SEBRING, MAHONING COUNTY, OHIO, AS FOLLOWS:

 

Section 1.        That the Sebring Water and Sewer Rules and Regulations are hereby amended to provide as follows:

 

Section 34.1    No person or entity shall be entitled to establish any new water and sewer account if the person or entity is currently delinquent on any water or sewer account.  In the event that the person or entity resolves said delinquency by payment in full, a new water account may be properly applied for and opened.

Section 2.        All remaining provisions of the Sebring Water and Sewer Rules and Regulations which are not modified herein shall remain in full force and effect.

Section 3.        That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of Section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.

Section 4.        That this Ordinance is hereby determined to be an EMERGENCY MEASURE, necessary for the immediate preservation of the public health, safety and welfare of the citizens of the Village of Sebring, Ohio and for the further reason for the need to address persons who fall delinquent in one account and then attempt to set up new accounts in the same persons name.
