AN ORDINANCE DECLARING THE NECCESSITY TO RENEW A ONE MILL TAX LEVY IN EXCESS OF THE TEN MILL LIMITATION FOR RECREATIONAL PURPOSES; CERTIFICATION TO THE BOARD OF ELECTIONS UPON WHICH IT WILL BE VOTED BY THE ELECTORATE AT THE GENERAL ELECTION ON NOVEMBER 8, 2011.

 

 

WHEREAS the Auditor of Mahoning County, Ohio has certified the amount of taxes that may be raised by each one mill of taxes levied for a renewal and is attached and incorporated herein; and

 

WHEREAS the Council of the Municipality of Sebring, being the taxing authority, has determined that the amount of taxes that may be raised within the ten mill limitation will be insufficient to provide for the necessary requirements of the Municipality of Sebring, and for recreational purposes, pursuant to Section 5705.19(h) of the Ohio Revised Code.

 

NOW, THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE MUNICIPALITY OF SEBRING, MAHONING COUNTY, OHIO:

Section 1:        That it is necessary to place a tax levy in excess of the ten mill limitation for the purpose of providing additional revenue for recreational purposes pursuant to section 5705.19(h) of the Ohio Revised Code.

 

Section 2:        The amount of the increase in the rate that is necessary to levy shall be one (1) mill for each One and 00/100 Dollar ($1.00) of taxable valuation, which amounts to 10/100’s for each One Hundred and 00/100 Dollars ($100.00) of taxable valuation.

 

Section 3:        The renewal levy shall be for a period of five (5) years commencing at the earliest time permitted by law.

 

Section 4:        That this levy is a renewal tax in addition to any existing levy or levies in excess of the ten mill limitation for recreational purposes.

 

Section 5:        That the renewal levy shall be upon the tax duplicate of the current taxable year 2011 and collected in 2012 and thereafter, provided, a majority of electors voting thereon vote in favor thereof.

 

Section 6:        That the question of levying the renewal tax provided herein shall be submitted to the electors of the Municipality of Sebring at the General Election to be held at the usual voting places within said Municipality of Sebring, on the 8th Day of November, 2011.

 

Section 7:        That the Clerk of Council be and she is hereby directed to certify a copy of this Ordinance to the Board of Elections of Mahoning County, Ohio, as provided by law and notify the Board of Elections to cause Notice of Election on the question of levying said tax to be given as required by law.

Section 8:        That it is FOUND and DETERMINED that all formal actions of this Council relating to the passage of this Ordinance or adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees which resulted in such formal actions were made in compliance with all legal requirements, including those of section 121.22 of the Ohio Revised Code, all pursuant to Section 3.11 of the Charter of the Village of Sebring.
